End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Alchemy Merch ("we," "us," or "our") governing your use of the Alchemy Merch mobile application (the "App").

By installing or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a mobile device that you own or control, solely for your personal, non-commercial use to access the Alchemy Merch platform.

2. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices, labels, or marks in the App
  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or interfere with the App's functionality
  • Use the App to scrape, harvest, or collect data from our platform

3. Intellectual Property

The App and all content, features, and functionality (including but not limited to design, graphics, text, and code) are owned by Alchemy Merch and are protected by copyright, trademark, and other intellectual property laws. This Agreement does not grant you any rights to our trademarks, logos, or brand assets.

4. Third-Party Services

The App provides access to our website, which is hosted by Shopify and uses third-party services including Google Firebase for analytics and crash reporting. Your use of these services is subject to their respective terms of service.

5. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Alchemy Merch be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

7. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates this Agreement or is harmful to other users or our business. Upon termination, your license to use the App is immediately revoked. You may terminate this Agreement at any time by uninstalling the App.

8. Changes to This Agreement

We reserve the right to modify this Agreement at any time. Changes will be reflected by the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
